Bakers & Co. Australia Pty Ltd (the offender) is a company that operate a pizza and biscuit production bakery. On 6 April 2016 a labour hire worker, who had commenced work with the offender on 1 April 2016, was tasked with cleaning a crumb auger. The crumb auger was an item of plant that was unguarded. There was a risk created by access to the crumb auger of shearing, entanglement, entrapment and crushing due to the lack of guarding. The offender failed to guard the crumb auger and failed to provide such information, instruction and training to persons cleaning the plant with respect to the dangers posed by crumb auger. During cleaning, the auger started turning and the worker’s hand became stuck resulting in deep lacerations. The offender pleaded guilty to both charges and was with conviction sentenced to pay a fine of $30,000 and to pay costs of $3,430.
