Shamas Arshad (‘the offender’) was employed as a Security Patrol Officer in July 2014. On 5 June 2015 he slipped and injured his neck while opening the entrance gates at Fawkner Cemetery. He lodged a Worker’s Injury Claim Form in late July 2015 and in August the WorkCover Agent denied liability based on an IME report and circumstance investigation. Following a conciliation hearing in October 2015, the Agent accepted liability and the offender commenced receiving weekly payments. In April 2016 the Agent referred the matter to WorkCover as the offender had returned to work whilst receiving payments of compensation. The offender had been observed on surveillance working as a taxi driver. He was also found to be working as a representative of a supplier/manufacturer of dental instruments. Between October 2015 and March 2016, the offender fraudulently received $26,479.60 in payments of weekly compensation. The offender pleaded guilty and was convicted and sentenced to pay a fine of $3,000.00 and to pay costs of $1,000.00. (restitution of $26,479.60 had already been recovered by WorkSafe)
